
James McMullan Associate
Mr. McMullan graduated from the University of South Alabama in 1990 with a Bachelor of Arts in Fiction Writing and a Minor in Accounting. He received his Juris Doctorate from Samford University, Cumberland School of Law. That same year he was admitted to the Alabama State Bar and the Federal Courts of both the Northern and Middle Districts of Alabama.
In 1997, Mr. McMullan accepted a position with the 10th Judicial Circuit as a law clerk for the Honorable William J. Wynn. Mr. McMullan’s responsibilities included the researching and writing of bench memoranda for his judge on issues that arose during the pre-trial, trial, and post-trial phases of litigation.
After completing his tenure as a law clerk, Mr. McMullan opened his own law office. Due to the general nature of this law practice, Mr. McMullan quickly gained experience in all types of litigation, e.g., criminal defense, personal injury, divorce, construction, etc., as well as those areas considered “office law”, e.g., drafting wills and trusts, contracts, business entity selection and governance, probating estates, to name a few.
On March 18, 2004, Mr. McMullan and his clients began their association with Gentle Turner & Sexton.
Mr. McMullan played a significant role for Gentle, Turner & Sexton in Winston, et al. v. Jefferson County, et al. at the federal level. Winston was a class-action lawsuit filed on behalf of the property owners in Jefferson County whose property had been sold by the county at tax auctions for more than what was owed. The case ended up settling for over $30,000,000.00.
While Mr. McMullan continues to handle a diverse range of cases, his current time is mostly divided between litigating, probating estates, and advising small and middle market private companies on issues ranging from entity selection, through formation, to governance issues.
Mr. McMullan teaches at Virginia College. He has taught English and legal classes at the undergraduate and graduate level since 1999. Currently, he teaches a triumvirate curriculum of Legal Research, Analysis and Writing, Property Law, and Wills, Trusts, and Estates.
Mr. McMullan is a member in good standing with the Alabama State Bar, Alabama Criminal of Defense Lawyers Association, the Birmingham Bar, the Bessemer Bar, the American Bar Association, specifically: the Business Law section, Middle Market and Small Business Committee; Litigation section, Pre-trial Practice and Discovery Committee; and Real Property, Probate & Trust Section, Real Property Litigation Committee.
Mr. McMullan is currently working on a paper for publication regarding the duties owed by a director to the closely-held corporation.
